Brazil’s data protection authority, under the administration of President Luiz Inácio Lula da Silva, has recently directed ByteDance, the parent company of TikTok, to pay a substantial fine of approximately million. In its recent judgment, the regulatory body highlighted that TikTok had violated crucial data privacy laws by improperly handling the personal data of children and teenagers. Reports indicate that the platform may have processed the data of at least 8 million young users without a legitimate legal basis or the necessary protective measures. The authority emphasized systemic issues in TikTok’s age-verification system, allowing minors to access content without appropriate safeguards in place.

Additionally, Brazil’s data protection authority has ordered ByteDance to erase all data that was compiled in violation of these regulations. The company has until the next ten days to appeal the decision if it chooses to do so. As part of the ruling, there is a clear directive for TikTok to develop a more robust framework aimed at protecting youth users. The authority pointed out that TikTok’s “logged-out feed” feature enables browsing without creating an account, which potentially facilitates minors circumventing age-verification methods. This feature is currently available in Brazil, while it remains restricted to registered users in regions like the United States and Europe.

This regulatory action corresponds with similar initiatives globally, where countries such as Australia, Canada, and Indonesia are taking steps to safeguard minors online. Earlier this month, Brazil also suspended the livestreaming capabilities of Discord, another popular platform, following tragic incidents linked to the exploitation of minors on social media.
