Thousands of individuals from Western nations have reportedly joined the Israeli military amidst the ongoing conflict in Gaza, raising significant questions about the implications of international law concerning foreign nationals allegedly implicated in acts against Palestinian civilians. Recent data obtained by the Israeli non-governmental organization Hatzlacha indicates that more than 50,000 soldiers in the Israeli military possess at least one additional citizenship, predominantly holding passports from the United States and various European countries.

The resumption of hostilities on October 7, 2023, has resulted in extensive loss of life, with reports stating that at least 72,061 individuals have died in what human rights organizations have deemed war crimes and crimes against humanity. In light of this, various rights groups globally are seeking avenues to hold foreign nationals accountable for their involvement, many of whom have publicly shared footage of their acts on social media.

Analysis of the data reveals that approximately 12,135 soldiers in the Israeli military are U.S. passport holders, the largest group by nationality. This is followed by 6,127 French citizens, with individuals from several other nations, including Russia, Ukraine, and Germany, also enlisting. Notably, South Africa, which has publicly condemned Israel’s actions and taken legal steps at the International Court of Justice (ICJ), has over 589 citizens serving in the Israeli military.

Experts in international law assert that individuals can be held criminally liable for war crimes regardless of nationality. However, the primary challenge resides in prosecuting these individuals in their respective countries. This complexity has historically hindered accountability for members of foreign militaries involved in unlawful conduct during conflicts.

Recently, initiatives have emerged encouraging legal proceedings against foreign nationals involved in the conflict. In the UK, for instance, a joint report by the Palestinian Centre for Human Rights and the Public Interest Law Centre has been submitted for investigation into alleged war crimes committed by British soldiers. Similarly, Europe has seen cases against individuals linked to actions during the Gaza conflict, underscoring growing international scrutiny.

The Hind Rajab Foundation, named after a young Palestinian girl, is at the forefront of efforts to collect data on Israeli soldiers involved in the conflict, including those who hold dual citizenship. This foundation underscores the commitment within international civil society to pursue justice and accountability for all alleged participants in actions against civilians, irrespective of nationality.

According to the United Nations Genocide Convention, member states must take action against genocide, further complicating the legal landscape for dual nationals serving in the Israeli military. As international and regional dynamics evolve, calls for accountability remain strong, illustrating a unified front for justice from various global actors.

This situation continues to unfold, prompting heightened attention to the responsibilities of foreign nationals in conflict zones, the obligations of their home countries, and the broader implications for international law.
