Nicholas Kaufman, a British-Israeli defense attorney affiliated with a Netanyahu advisor, conveyed this message during a meeting in May, as reported by USA Zine. He cautioned that failure to withdraw arrest warrants for Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant could lead to dire consequences for both Khan and the ICC itself.

During the meeting, Kaufman suggested a proposal from a legal adviser to Netanyahu that would allow Khan to “climb down the tree.” The proposal included a potential reclassification of the arrest warrants and associated information as “confidential.” This categorization would enable Israel to review the allegations discreetly without disclosing the details to the public, thus facilitating a private challenge against the charges.

The ICC had issued arrest warrants for Netanyahu, Gallant, and Hamas leader Mohammed Deif in November, alleging war crimes and crimes against humanity related to the October 7, 2023, Hamas-led attacks on Israel and the subsequent military actions in Gaza. Following these developments, the Israeli leaders became internationally sought suspects, and member states of the ICC are legally obliged to arrest them, although hesitance has been observed among some countries.

Francesca Albanese, the United Nations special rapporteur on the human rights situation in the occupied Palestinian territory, criticized nations that have permitted Netanyahu to traverse their airspace en route to the United States. She indicated that such actions could be in violation of international law, given their obligations as signatories to the Rome Statute, which established the ICC.

Kaufman later confirmed to USA Zine that he had urged Khan to find a way to extricate himself from what he characterized as errors, though he clarified he was not authorized to make proposals on behalf of the Israeli government. Both Khan and his wife, Dato Shyamala Alagendra, who attended the meeting, considered Kaufman’s remarks to be a direct threat.
